I was excited to learn about Tucson’s newest music venue called “La Rosa” at The Benedictine at 800 N. Country Club Road coming soon! With preservation and high architectural aesthetics, they are transforming the chapel space with better sound quality (although chapels are known for their amazing acoustics) as well as new lighting behind the columns. They are also adding a restaurant adjacent called Rosie’s Tavern. The original Benedictine Convent and Perpetual Adoration Shrine is now on the National Registry of Historic Places. It was built in the Spanish Revival style beginning in 1939 designed by famed architect Josias Joesler and adapted by Roy Place. I have engaged with the Benedictine in two different capacities over the years. During the pandemic it served as a refugee transition station where my family and I would regularly donate to help support the families there. Later, we lived in one of the luxury loft apartments while we were remodeling our home. Now, amidst all of the paperwork that has been provided to you about the property, you are sent the CC&Rs. What are those? And why does it matter to my purchase of this home? CC&Rs stand for the Covenants, Conditions, and Restrictions. They are the rules between property owners and neighbors, oftentimes in a subdivision or a homeowners association, but not always. As early as the 1900s, these CC&Rs prevented people of color and other marginalized individuals from buying and renting in certain neighborhoods. These racist covenants became illegal after the passage of the 1968 Fair Housing Act. My latest blog article is not just a “history lesson” on U.S. residential segregation, however, because these racist CC&Rs still exist — here in Pima County, Arizona. This week, while collecting paperwork for my upcoming house listing, I noted the screenshots of the cover pages of the CC&Rs attached to this house, built in 1955. (see screenshots)  Some title and real estate companies are choosing to simply leave this information out of the listing packets with the hopes that it will not highlight the historical discriminatory document that is tied to the property — in the present day. In honor of Dr. Martin Luther King, Jr. and Civil Rights Day, let’s explore how King fought for Fair Housing. What civil rights efforts directly led up to the Fair Housing Act and how was Dr. King involved? The Civil Rights Act was passed in 1964 and the Voting Rights Act passed in 1965, both of which codified legal protections against racial discrimination. King and other civil rights advocates lead the Chicago Freedom Movement in 1965 to 1966 in Chicago, Illinois. It fought against discrimination in housing specifically, as well as in education and employment. During these efforts, he directly negotiated agreements with city leaders to address housing inequality. He advocated for the right to buy a home anywhere. In 1967, King spoke about the need for federal fair housing legislation in his speech titled “The Other America” at Stanford University. The Fair Housing Act was signed into law in 1968, one week after Dr. King’s assassination. President Lyndon B. Johnson increased pressure on Congress to pass the bill after King’s assassination. What is the Fair Housing Act? Originally passed in 1968, it made it illegal to discrimination in the sale, rental, or buying of housing based on race, color, religion, or national origin. It was first amended in 1974 to include protections against discrimination based on sex. And in 1988, it was modified again this time to protect those with disabilities and families with children against housing discrimination. “[Now], over 50 years since Dr. King’s assassination and the passage of the Fair Housing Act, there is still a lot left to achieve in the realm of fair housing.
